Can A Landlord Leave You Without AC?
Before you sign a lease agreement, it’s a good idea to check that working air conditioning is included in the lease. Otherwise, your landlord might not be obligated to fix the air conditioning in a timely manner. In fact, air conditioning is not considered a habitation necessity in most states. Only Dallas, TX, and Arizona require working AC for habitation.
If a properly functioning air conditioning system isn’t included in the lease agreement, you may still be able to rely on the implied warranty of habitability. Although this unspoken agreement isn’t airtight, it can still legally bind your landlord. If the air conditioning was working when you signed the lease agreement, the implied warranty of habitability says it must remain working in order for the lease to be upheld.
Choosing A Repair Company
Many landlords are happy to let renters choose a repair company to get their air conditioning back up and running as soon as possible. This takes the stress away from the landlord and lets you choose a company you’re comfortable with. When you do have a professional come to make repairs, always save any transaction invoices so that you can pass the cost of repairs on to your landlord. Some landlords will reimburse you, others will pay the repair costs directly, and still others will deduct the cost from your rent.
